Conditions of Supply

  • The client will make the agreed payments for the non exclusive use of the LandScan software applications and any agreed support services.
  • The client agrees to restrict the use of the LandScan software applications to users on a single network of PC’s under the clients full control.
  • The client agrees not to pass the LandScan software applications in any form to a third party without the prior consent of WPA Consultants Ltd.
  • The client agrees that changes made to the design and function of the software by any party, without the involvement and acceptance by WPA Consultants Ltd, will void any guarantees made by WPA Consultants Ltd.
  • The client acknowledges that the copyright and intellectual property rights associated with the creation and design of the LandScan software applications, excepting those owned by the Microsoft Corporation, remain with WPA Consultants Ltd at all times and following any alterations made to the individual applications by any party.
  • The client acknowledges that the software supplied requires the appropriate licences from the Microsoft Corporation to run Microsoft Access, Excel and Word.
  • The client acknowledges that the limit of liability attributable to WPA Consultants Ltd in respect to the use of the software is the value of the software (meaning the fees paid to WPA Consultants Ltd for use and and the provision of support services in any one year).
  • WPA Consultants Ltd acknowledges and will fully respect that the site records to be held in files associated with the LandScan software applications are exclusive to the client and subject to the client’s policies concerning confidentiality and environmental information. WPA Consultants Ltd further agrees that these records can be exported to another application without reference to WPA Consultants Ltd.
